SHIPMENT: 1) All orders MUST indicate the type of delivery and shipment. In the absence of such instructions, shipment shall be done through regular ground shipping and handling. 2) Requests for next day or 2 day air shipping must accompany credit card information and will be charged based on weight of final package and ship to the final destination. 3) Hazardous Materials may be shipped by air, but must be packaged in special boxes and with adequate warnings. There would be additional charges for shipping and handling of such materials.
4) For shipment outside of the USA, User shall make special arrangements with Provider. All fees and shipping and handling specifications are subject to prior authorization and written agreements.
RETURING ORDERS (Damaged or Wrong Item sent):
1) All the items must be returned in their original packaging within 30 days of receipt. 2) Returned items shall be subject to a 15% restocking fee, unless wrong items have been sent. 3) All returned items must be accompanied with the original order form and invoice. 4) There will be 14 Days processing period from the date of receipt of the returned item. 5) All applicable refunds shall be credited to the charged credit card.
SALES TAX: Provider is required to calculate applicable state and local tax on items shipped to an address in California. PAYMENT TERMS:
1) Payments shall be made in U.S. dollars, unless otherwise instructed in writing. 2) All payments are due prior to shipment, unless otherwise parties agreed in writing. Provider at its sole discretion may arrange for differed payments. 3) Failure to make differed payments may make future shipments subject to cancellation and/or part shipment. 4) Payments through personal or business checks shall be subject ot 10 days delay shipment or until the check is cleared.
ADDITIONAL TERMS: 1) Force Majeure: Provider shall not be liable for any delay in or impairment of performance resulting in whole or in part from Acts of God, labor disruptions, shortages, inability to procure product, supplies or raw materials, severe weather conditions, or any other circumstances or cause beyond the control of Body Shop Supplies For Less in the conduct of its business. 2) Material of Trade: User guarantees that if the order material are "materials of trade" as defined in the Hazardous Materials Regulations in Title 49 of the CFR, that the goods will be used in direct support of its business, which is not transportation, and that such goods shall not be resold or transported in a vehicle other than one owned by itself. Waiver, Choice of Law and Venue 3) Export Policy: User represents that all purchased items are for domestic use and if exported to other countries, User shall be in compliance with all rules and regulations governing US Exporting laws.
COMPLETE AGREEMENT:
The sales terms and conditions in Provider’s order/purchasing forms, receipts, quotations, invoices, catalog, web-site are incorporated herein by reference, and constitute the exclusive and entire agreement between User and Provider.
SEVERABILTY:
If any provision of these Terms and Conditions proven to be illegal or unenforceable, the rest of the terms shall remain in force.
